NAUTICAL SOLUTIONS POLICIES & PROCEDURES

REGISTRATION

Registration for all Programs is through the online registration system on the Nautical Solutions website. For all programs, full payment and registration information must be received to reserve your service. For all services, a roster of attendees (or participant registration) must be provided within 7 days of the service. For any service that requires materials to be ordered and distributed for participant review prior to the service, accurate rosters and registrations must be received within 14 days of the service’s inception. If appropriate registration/rosters are not available 14 days or more prior to the service, the facility or participant has the right to request to reschedule the course per the other terms provided below.

REGISTRATION CHANGES, REFUNDS & CANCELLATION

All services are nonrefundable. Rescheduling requests must be made, at minimum, 14 days prior to the first service date. Rescheduling requests made 14 days or more before the service start date may be applied to a future service within 1 year of the original registration or payment, whichever occurred first. Any requests to reschedule services are subject to Nautical Solutions availability and must be completed within 1 year of the original registration or all funds paid by the client will be forfeited. Extensions for rescheduling may be accepted in extenuating circumstances but must be requested, in writing, within 1 year of the original registration or payment, whichever occurred first.

These terms include private courses, host facilities and other private services, here forth referred to as private service hosts. Should a private service host cancel a service within 14 days of the scheduled date, all of their fees paid to Nautical Solutions will be forfeited. Any request to alter the service dates of a private service 14 days or less before the service date, is at the sole discretion of Nautical Solutions and its’ contractors. Host facilities are responsible for setting terms for any funds that were not paid directly to Nautical Solutions (e.g. services hosted by a facility where participants pay the host facility directly).

Nautical Solutions reserves the right to cancel a service at any time, for any reason. If a service is cancelled by Nautical Solutions, participants and hosts may be notified via the email that was provided at registration, the email address that the client most recently used for correspondence, or both. Once a service has begun, a refund may be issued less the cost of services already received, at the sole discretion of Nautical Solutions. Your registration fee may be transferred to another program or refunded, unless the cancellation was made as a result of the conduct/behavior explained below.

CONDUCT & BEHAVIOR

Nautical Solutions staff reserves the right to dismiss, without refund, any participant whose behavior, including but not limited to bullying, substance use, foul language and reckless/irresponsible behavior. This also includes any unlisted event or behavior that affects the well-being, mental health, enjoyment and/or safety of others.

WEATHER

Programs occur rain or shine and we plan to be on the water in a variety of weather conditions. Nautical Solutions staff will take into consideration any weather threats and determine if it is safe to be on the water. Your N/S instructor has full capability to halt or cancel instruction based on weather conditions. We will make every attempt to reschedule services should we need to cancel based on weather conditions. Keep in mind that the weather on the water is variable. Please dress and be prepared for a variety of weather conditions. Your service fees are not refundable should you decided to dismiss yourself from the course for your ill preparedness.

SAFETY

Our programs are built on the US Sailing/Powerboating principles of safety, fun and learning. Participants shall follow instructions given by instructors and use their own best judgement to maintain their personal safety. Participants shall not engage in any behavior that puts themselves or others at a safety risk.

All participants must wear a USCG approved lifejacket at all times while on the dock, in boats, and on or in the water. Lifejackets are not provided by N/S. You must bring your own USCG approved life jacket.

All participants must wear closed-toe shoes, preferably with non-marking soles, at all times. This includes while in class, on docks and on boats.

LOST OR STOLEN ITEMS

Nautical Solutions is not liable for any lost or stolen items. Please keep your belongings with you at all times and do not leave anything visible while you are not actively watching nearby.

DISCOUNTS

Active military and veterans are entitled to a 10% discount on registration fees. This is only granted if you send us proof of your military status BEFORE a payment is made.

Current students enrolled full-time at the university level, are eligible for a 5% discount of registration fees. This is only granted if you send us proof of full-time student status BEFORE a payment is made.

AGENCY

Nautical Solutions and its’ contractors may make any changes to these policies at any time pending approval by Cpt. Jaimie Bartlett.

 


RELEASE OF LIABILITY, PROMISE NOT TO SUE, ASSUMPTION OF RISK AND AGREEMENT TO PAY CLAIMS

By participating in Nautical Solutions programs, activities or events, you agree to the following:

I understand and acknowledge:

a. that these activities, by their very nature, pose the potential risk of serious injury/illness to individuals who participate,

b. (b) that in order to participate in these activities, I agree to assume liability and responsibility for any and all potential risks which may be associated with participation by me or my dependents in such activities,

c. (c) that N/S, its employees, officers, agents, or volunteers shall not be liable for any injury/illness suffered by me which is incident to and/or associated with preparing for and/or participating in the activity (ies),

d. (d) that photos and/or videos of me and/or my child/ren participation in these activities may be taken for the purpose of assisting in the instruction and/or promotion of future programs

e. (e) I or my dependent/s have no known medical condition which may pose a risk to the health and safety of me, my dependent/s or others by participating in the registered activity(ies)

 

In consideration for being allowed to participate in this Activity, on behalf of myself and my next of kin, heirs and representatives, I release from all liability and promise not to sue Nautical Solutions and its employees, officers, directors, volunteers and agents (collectively “Nautical Solutions”) from any and all claims, including claims of the Nautical Solutions negligence, resulting in any physical or psychological injury (including paralysis and death), illness, damages, or economic or emotional loss I may suffer because of my participation in this Activity, including travel to, from and during the Activity.

 

I am voluntarily participating in this Activity. I am aware of the risks associated with traveling to/from and participating in this Activity, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I understand that these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to travel; or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Activity, including travel to, from and during the Activity. I agree to hold Nautical Solutions harmless from any and all claims, including attorney’s fees or damage to my personal property, that may occur as a result of my participation in this Activity, including travel to, from and during the Activity. If the University incurs any of these types of expenses, I agree to reimburse Nautical Solutions. If I need medical treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

 

I am 18 years or older. I understand the legal consequences of agreeing to this document, including (a) releasing Nautical Solutions from all liability, (b) promising not to sue Nautical Solutions, (c) and assuming all risks of participating in this Activity, including travel to, from and during the Activity. I understand that this document is written to be as broad and inclusive as legally permitted by the State of California. I agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms. I have read this document, and I am agreeing to it freely. No other representations concerning the legal effect of this document have been made to me.

 

If Participant is under 18 years of age:

I am the parent or legal guardian of the Participant. I understand the legal consequences of signing this document, including (a) releasing the University from all liability on my and the Participant’s behalf, (b) promising not to sue on my and the Participant’s behalf, (c) and assuming all risks of the Participant’s participation in this Activity, including travel to, from and during the Activity. I allow Participant to participate in this Activity. I understand that I am responsible for the obligations and acts of Participant as described in this document. I agree to be bound by the terms of this document.

By partaking in any Nautical Solutions service, you are agreeing that you have read these documents in their entirety, and you are agreeing to them freely. No other representations concerning the legal effect of this document have been made to you.
